Terms of Use
NTUC Health Co-operative Limited and its related or affiliated co-operatives and organisations (collectively, “NTUC Health” or “we”) provide users and/or customers with various services, resources, content and/or information through our websites (including ntuchealth.sg and my.ntuchealth.sg) (“our Websites”) and our mobile applications (“our Mobile Applications”) (collectively, the “Digital Services”).
Acceptance of Terms
Please read the following Terms and Conditions (the “T&Cs”) carefully. By accessing and/or using the Digital Services, you agree to be bound by the T&Cs, and consent to the collection, use and disclosure of your personal data as described in these T&Cs. If you do not agree to the T&Cs, you must not access and/or use our Digital Services.
NTUC Health reserves the right to and may change and/or amend the T&Cs from time to time by posting updated T&Cs on the Digital Services. Every time you access the Digital Services, please check the T&Cs to ensure you understand the T&Cs that apply at that time. If any modification is unacceptable to you, you must cease using the Digital Services immediately. If you do not cease using the Digital Services, you will be deemed to have accepted the change.
Certain sections or pages on our Digital Services may also contain additional terms and conditions, which are in addition to these T&Cs. You are required to comply with any such additional terms and conditions in addition to these T&Cs.
Member Account, Password and Security
To use NTUC Health services and/or access NTUC Health resources, content and/or information through the Digital Services, we may require you to register an account with us. To register for an account, we may request certain personal information. You will also be asked to create a password upon registration to secure your account. You represent and warrant that all details provided by you are true, accurate, current and complete.
NTUC Health also requires you to maintain and promptly update your registration data to keep it true, accurate, current and complete. If you fail to comply with any of the provisions of the T&Cs, in our reasonable opinion, we have the right to suspend or terminate your account and refuse you any current or future use of any of NTUC Health services including our Digital Services.
You are entirely responsible for: (i) maintaining the confidentiality of your password and security of your account; (ii) restricting access to your account to only yourself and not allowing any third party to access your account; and (iii) any purchases and activities that are submitted under your account whether or not such purchases and activities are undertaken with your knowledge or authority. You agree to (i) notify us immediately, by emailing to DPO@ntuchealth.sg, of any unauthorised use of your account or any other suspected breach of security; and (ii) ensure that you properly log out of your account at the end of each session.
NTUC Health will not be liable for any loss that you may incur as a result of a third party using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by NTUC Health for any wrongful use of your account or password. You may not use any other person’s account at any time without the express permission of that person.
Privacy and Protection of Personal Information
Please see our Privacy Policy for disclosures relating to the collection and use of your personal information. The Privacy Policy is incorporated into and forms part of these T&Cs, and applies to your access and/or use of the Digital Services. You consent to our Privacy Policy and our collection, use and disclosure of your personal data in accordance with our Privacy Policy.
Restrictions on use of the Digital Services
You shall access and use the Digital Services only in accordance with all applicable laws and regulations, and with these T&Cs. Unless otherwise specified, the Digital Services are for your personal and non-commercial use only.
In addition to and without prejudice to the generality of the foregoing:
NTUC Health shall have and reserves the right to disclose any information as we deem necessary to satisfy any applicable law, regulation or legal process, or to edit, remove, or refuse to post any information or materials in our sole discretion.
Notifications and Alerts
You agree to receive pre-programmed notifications from and/or in relation to our Mobile Applications on your mobile telephone or other handheld devices.
As part of the services provided, we may send you notifications or emails about articles or materials that may interest you. You may unsubscribe by indicating your preferences in our Mobile Applications.
User Data usage Information
Some functionality of our Digital Services, including online payment, purchase and location based services and functionality, may require the transmission of information provided by you including but not limited to user names and passwords, addresses, e-mail addresses, financial information (such as credit card numbers), the International Mobile Equipment Identity number accessed in your device, phone-book information, information related to GPS location (“User Information”). You hereby consent to the transmission of User Information to NTUC Health to record, process and store such User Information as necessary for our Digital Services’ functionality and for purposes described in the Privacy Policy.
Analytics Data collections
We collect information and data regarding your use of our Digital Services. You hereby consent to us processing and analysing such information and data using our backend systems to generate analytics visual reports, including graphs and statistics, of the data collected.
No Warranty
The Digital Services and all the content, information and materials therein are provided on an “as is” basis without warranties of any kind. NTUC Health does not warrant the accuracy, adequacy or completeness of the Digital Services, and hereby disclaims any warranty including but not limited to:
Any content, information and material downloaded or otherwise obtained through the use of the Digital Services is done at your own discretion and risk and you shall be solely responsible for any damage to your computer system or loss of data that may result from the download of any such content, information and material.
Exclusion of Liability
NTUC Health shall in no event be liable for any damage, loss or expense howsoever caused as a result of your use and/or access of the Digital Services, including without limitation, direct, indirect, special, or consequential or punitive damage, or economic loss arising from or in connection with:
Links to Third Party Websites, Applications and/or Content
The Digital Services may contain hyperlinks to third party websites or applications for your convenience. Such linked websites or applications are not under our control and we are not responsible for the contents or activities of such linked websites or the consequences of accessing any link in any such websites. We are also not responsible for any forms of transmission received from any third party websites. The inclusion of any link does not imply endorsement by NTUC Health of any such third party websites or its content or any association with its owners or operators.
You agree that any access to and/or use of such third party linked websites or applications is at your own risk and any dealings with any such third parties (and any other terms and conditions associated with such dealings) are solely between you and the third party. We shall not be liable or responsible in respect of any such dealings with third parties.
Intellectual Property
You acknowledge that the Digital Services contain information, data, software, photographs, graphics, typefaces, music, sounds and other material (the "Content”) that are protected by copyright, trademarks, and other intellectual property rights owned by us, our affiliates, our strategic partners and/or our licensors.
You may not establish a link to our Digital Services without our express written consent. Even where written consent has been obtained, we reserve the right to withdraw linking permission without notice. The name of NTUC Health may not be used in any way by you, including but not limited to for the purposes of advertising and/or publicity of any content, information and/or material on our Digital Services. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
Modification of T&Cs
We reserve the right to modify and make changes to any of these T&Cs, including but not limited to the fees and charges relating to your use of our Digital Services, without notice.
All modifications to these T&Cs will be reflected by the posting of the amended terms and conditions on our Digital Services.
Modification of Websites, Mobile Applications and Digital Services
We reserve the right to update or modify the Digital Services from time to time. We do not guarantee that the Digital Services, or any content on it, will always be available or uninterrupted. We reserve the right to, at any time and from time to time, suspend or discontinue any of the Digital Services without notice and without ascribing any reasons. You agree that we shall NOT be held liable or responsible in any way to you or to any third party for any modification, suspension or discontinuance of the Digital Services.
Termination
NTUC Health shall have the right to, in its sole discretion, suspend or terminate your account and refuse to grant you access to the Digital Services, without any notice and for any reason whatsoever, including but not limited to where we have reason to believe that you have breached or acted inconsistently with the T&Cs.
Governing Law
These T&Cs shall be governed and construed in accordance with the laws of Singapore. By accessing the Digital Services, you hereby agree that the Singapore Courts will have non-exclusive jurisdiction in relation to any dispute arising out of or in connection with these T&Cs and/or your use of and/or access to the Digital Services.
Miscellaneous Terms
A person who is not a party to these T&Cs shall have no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any of these T&Cs.
A failure by us to exercise or enforce any rights conferred upon us by or under these T&Cs shall not be deemed to be a waiver or variation of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time.
If any provision of these T&Cs is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these T&Cs shall not be affected.
